More couples opt for amicable divorce through mediation

Some call it "friendly divorce," others call it "conscious uncoupling." Whatever the name, a growing number of divorcing spouses are choosing to end their marriages with an eye toward remaining amicable. For many Minnesota couples, this is accomplished through divorce mediation.

Unlike traditional divorce, which takes place in an adversarial setting where one spouse's interests are often pitted against the other, divorce mediation is a cooperative process. Thus, it is most effective when both spouses are committed to working together toward a resolution that works for both of them. Although divorce mediation is not right for everyone, it can offer a number of benefits to those who choose to dissolve their marriages in this way.

Divorcing parents often pursue mediation as a way to minimize the impact of the divorce on their children. By helping couples eliminating unnecessary conflict and work through issues together, divorce mediation can help lay the foundation for a positive co-parenting relationship. For the same reasons, mediation can be an effective solution for divorcing spouses who have business ties or expect to remain in close contact for any other reason.

Another major advantage that divorce mediation offers over traditional divorce litigation is that it gives divorcing spouses control over the outcome of their own case. Since they are the ones who are most familiar with their own family circumstances, this gives them a better chance at a resolution that works well for everyone involved.

Compared to litigating a divorce, mediation also tends to be faster and less costly. And, for those who prefer to keep their family matters private, mediation can offer a greater degree of confidentiality than litigation.
